Our client received a letter on 29th April 2024 notifying her that she had been assessed as ineligible for Social Housing. The letter explained that, because she is married and her husband is living outside Ireland, she cannot apply for social housing until her husband moves to Ireland to join her. Client is an Irish Citizen, but her husband is a non-EU citizen. Her husband does not have permission to live in Ireland. For that reason, Client is not sure if, or when, he will be able to join her in Ireland. We are requesting a copy of the policy document/circular or other form of guidelines, on which the decision was based, i.e. which sets out the criteria for assessing an application in a situation where the applicant's spouse lives outside of Ireland. We are familiar with the Allocation Scheme and Means Policy public documents on eligibility. Unfortunately they do not contain the information that we need. We are looking for a copy of the internal guidelines, memos, circulars, or similar documents used by staff of South Dublin County Council when deciding that an application for social housing is ineligible in the above scenario.

Re: Crooksling Nursing Home, Blessington Road, N81, Dublin 24 We refer to the above-named site/area and we note that this site is owned by the HSE and the HSE offered the property to all State Stakeholders through the Intra-State Property Register and the Department of Children, Equality, Disability, Integration and Youth expressed an interest in Crooksling to facilitate the provisions of suitable accommodation to persons seeking international protection. We would be grateful for a full copy of the planning files/licenses for the property to be used as an international protection center. We seek this information under the Freedom of Information Act and Planning Acts. We would also be grateful for a copy of the grant of permission for this site to be used for tented accommodation. We act on behalf of clients who have concerns in relation to this site being used for the above accommodation due to the rural location, lack of facilities, breach of planning regulations, which would extend to proposed water, surface water and foul drainage system. Without proper planning this would cause a real risk and concern to the local area. This site is located in an area zoned Objective RU in the South Dublin County Council Development Plan 2000-2028, which seeks 'to protect and improve Rural Amenity and to provide for the development of Agriculture. Therefore we would propose this development would materially contravene the objectives of the South Dublin County Council Development Plan, particularly that of Policy H16 and would lead to demands for the uneconomic provision of further public services and facilities Pg. 1 in this rural area. The proposed development would therefore be contrary to the proper planning and sustainable development of the area.There is a significant increase in traffic and this will also lead to additional demand for access to services in an area that has no services to offer. The public road has no footpaths, there are no public lighting between the site and the closest town and is not safe for pedestrian access, there is poor vertical and horizontal alignment, lacks pedestrian, public lighting. We submit on behalf of our clients that this site is being used without permission and in breach of the planning acts and the Development plan. This development, by reason of its scale, design, mass and bulk, fails to respond to the site's sensitive context, it is visually incongruous to the rural area and would lead to the loss of rural amenity which materially contravenes Policy H23 Rural House and Extension Design Objective 1 and the RU zoning objective and would be contrary to the provisions of the South Dublin County Council Development Plan 2022-2028. We further submit this site has now caused serious public safety by reason of traffic and therefore is contrary to the proper planning and sustainability development in the area Our client has also brought to our attention that there are previous planning applications Our client has also brought to our attention that there are previous planning applications in this local area that have all since been refused for once off planning permission due We believe this accommodation center for international applicants does not have the proper planning to operate and therefore we ask that you furnish us with a copy of the planning permission for the site. Under the freedom of Information Act 2014, I am submitting a request for the following information: • Record(s) that demonstrates the number of surveillance devices/systems(whichever is most practical) utilized by your Council for (a) traffic management purposes, (b) for waste enforcement purposes and ( c) the number of community CCTV schemes the Council participates in, as well as (d) the number of CCTV systems operated for any other purpose other than those listed above. • I am also requesting a copy of the current Data Protection Impact Assessments on file for each CCTV system operated by the council (including CCTV systems in council buildings). • Please also direct me to your council's CCTV code of practice/policy as I have not been able to locate it online.

Under the FOI acts, I request the following: Records of the number of refugees accommodated in your local authority region during the years 2019, 2020, 2021, 2022, 2023. These people may be referred to as beneficiaries of temporary protection. Please state the age range and gender and type of accommodation recorded in terms of single or multi-occupancy dwellings. Please also provide records of correspondence or minutes of meetings in which concerns have been raised about the security of these refugees or the buildings within which they reside. Please provide records in relation to concerns raised during 2022 and 2023 about refurbishment works on properties in your local authority where the works relate to accommodation for refugees or beneficiaries of temporary protection.

Under the FOI Act 2014 and its amendments and regulations, I am seeking the following information from South Dublin County Council: A copy of all communication documents or emails, application documents, assessors reports and any other documents which formed part of any submissions made to South Dublin County Council to obtain a Street Furniture Licence under Section 254, Planning and Development Act, as amended, and Article 201(b) of the Planning and Development Regulations, as amended, for a premises in Rathfarnham, namely Dakco Ltd. (Revels Bar), 37 Main Street, Rathfarnham, Dublin 14, D14 PW02. As the licence must be renewed annually there should be a number of such applications for the licence and I am requesting a copy of the documents referred to above for each year the licence was granted.

1. Details of the number of planning enforcement notices that issued in the past 10 years due to a boundary wall of 1.2m in height being erected. 2. Details as to whether enforcement proceedings were pursued against the erection of the boundary wall at the site to the side of 1 Cloonmore Drive, Dublin 24. This site is zoned as OS and I note that planning permission was neither sought nor obtained to erect the boundary wall that surrounds this site. I also note this land was sold by SDCC! Furthermore I request all records pertaining to the sale of this land. 3. All records relating to enforcement reference S9154. This includes all emails that may have been deleted or recalled by staff. As a senior manager within a public sector office myself I am well aware that your IT department has the functionality to comply with this request. 4. All records relating to the failings of SDCC to publish a third party observation made to the planning portal until December 2023 under planning reference SD23A/0222 and all information relating to the errors contained within the signed Chief Executive's Orders dated the 31st October 2023. For context a decision on this planning application was made on the 31st October yet this observation was not published to the SDCC website until December 2023.
