Further to my 3 x FOI requests submitted to XXXX in July 2021 (attached) I am advised by the OIC that Section 11.9 of the act applies. As you will know, Section 11.9 states that '...a record in the possession of a service provider shall, if and in so far as it relates to the service, be deemed for the purposes of this Act to be held by the FOI body, and there shall be deemed to be included in the contract for the service a provision that the service provider shall, if so requested by the FOI body for the purposes of this Act, give the record to the FOI body for retention by it for such period as is reasonable in the particular circumstances ....' The OIC further advised me that '... For the purposes of the Act, a service provider means a person who, at the time the request was made, was not an FOI body but was providing a service for an FOI body under a contract for services, including an administrative arrangement between the parties....' Given that the department has a Service Level Agreement (attached) with XXXX there can be no disputing that XXXX is providing a service for an FOI body (DAFM). Therefore I request that the department gather the records from XXXX and process them in accordance with the act.

I’m looking for some journey logs and health certs but I only have the ear tags. This is in relation to two journeys: Journey 1: a truck was seen full of Irish weanlings at the port of XXXX in Spain, going to Tenerife. I would like a copy of the journey logs and health certificates. They were probably exported to Spain as calves earlier in the year. Ear tags: XXXXXXX, XXXXXX, XXXXXXX, XXXXXX, XXXXXXX, XXXXXX Journey 2: a number of Irish weanlings were seen at XXXXX port in Greece, they boarded a ferry for the island of Kos. They came from Italy so it is likely they were exported there as calves earlier in the year. Ear tags: XXXXXXX, XXXXXX, XXXXXX, XXXXXX I understand this will probably take longer than usual to locate the documents and so it may incur a charge.

To summarise I am looking for the records the Dept has of the calculations of N and P for the 2406 importations in the relevant years to confirm those importing holdings were not in breach of nitrates regs.

In reference to trader notice TN VECIT 04/2021 it states that Department Veterinary Inspectors (VIs) will accompany calves from Ireland to the control posts in Cherbourg during the peak season to verify the welfare of animals during transport. These inspections will be not be announced to exporters or transporters. This is a requirement of EU legislation on official controls. I have a report from 2019 and one from 2020 where a vet travelled to France, but did not go to the control post. I understand there were difficulties with travel due to covid in 2021 but could you please provide me with dates where a dept vet has accompanied calves to the control posts in Cherbourg during peak season this year and can I please have copies of the reports.

I want details of any notices served or warnings or recommendations issued by Dept of Agriculture or by any regulatory authority in Ireland or on mainland Europe. 5. How many calves/cattle/were loaded on each truck. How many live healthy cattle /calves were unloaded at destination from each respective livestock truck. 6. STOCKING DENSITY how much space allowed per animal depending on age /size.? 7.
