Our client received a letter on 29th April 2024 notifying her that she had been assessed as ineligible for Social Housing. The letter explained that, because she is married and her husband is living outside Ireland, she cannot apply for social housing until her husband moves to Ireland to join her. Client is an Irish Citizen, but her husband is a non-EU citizen. Her husband does not have permission to live in Ireland. For that reason, Client is not sure if, or when, he will be able to join her in Ireland. We are requesting a copy of the policy document/circular or other form of guidelines, on which the decision was based, i.e. which sets out the criteria for assessing an application in a situation where the applicant's spouse lives outside of Ireland. We are familiar with the Allocation Scheme and Means Policy public documents on eligibility. Unfortunately they do not contain the information that we need. We are looking for a copy of the internal guidelines, memos, circulars, or similar documents used by staff of South Dublin County Council when deciding that an application for social housing is ineligible in the above scenario.
