    which I understand are in the possession of Wicklow County Council, or to which Wicklow County Council has access (i)Reports prepared on behalf of Wicklow County Council in the early to mid 1990s by M.C. O’Sullivan Consulting Engineers in relation to the selection and suitability of a site for the Proposed East Wicklow Landfill at Ballynagran, Coolbeg and Kilcandra, County Wicklow. It is most likely that these reports will be found in: a)the County Council’s files on submitting an Environmental Impact Statement on the above named proposed landfill and other documents in March 1996 to the Minister for the Environment and Local Government for certification under Part IX of the Local Government Planning and Development Regulations, 1994; or, b) The Council’s files on an application made on 30 April 1997 to the Environmental Protection Agency for a Waste Licence, Reference subsequently withdrawn. ii) A report prepared by Mr P.J. Rudden of M.C. O’Sullivan Consulting Engineers and submitted to Wicklow County Council in 1996 or 1997 and addressing the potential problem of flooding. It is understood that this report advised construction of a large culvert of adequate capacity to take the increased runoff from the proposed landfill site under the local road and to convey this flow to the Three Mile Water River; and iii) A report on flooding in or around the vicinity of the Ballynagran landfill site prepared by or on behalf of Greenstar Southeast Ltd and presented to Wicklow County Council in August 2009 in response to a complaint about flooding received by the Council.

    from the Courts. I understand the information to be available in tabular (spreadsheet) form and has been submitted to the EPA as part of the RMCEI returns process. The information I seek is consistent with the publication of similar information by other prosecuting bodies. For instance, the EPA publishes details of successful prosecutions. The Office of Director of Corporate Enforcment publishes, in its annual report, a table of directors who have been disqualified following court orders. The Revenue Commissioners publishes the list of the tax defaulters, who made settlements in lieu of a court conviction. I do not seek information on parties acquitted or cases where the prosecution did not proceed. Information of this nature is supposed to be public under Article 34 of the Constitution, that justice be administered in public. As such it cannot be considered to be confidential or would ever have the character necessary to be treated as confidential. Under Section 17 of the Act I would ask that the information be released electronically in a .xls or similar file format. If amending the wording of the request is likely to reduce unnecessary workload I am happy to consider an alternative phrasing.
