All records, created on or after 1 April 2021: 1.1 directly related to the financial capability assessment which was carried out by DECC and any officials, servants or agents of DECC or the Minister of the Environment, Climate & Communications (the "Minister"), in the context of our Client's Lease Undertaking Application dated 9 April 2021 (the "LU Application"). 1.2 prepared by, or shared with DECC's external advisors, including but not limited to EY, in respect of this financial capability assessment. We note that s.11(9) of FOI Act provides that a record in the possession of a service provider is deemed to be held by the relevant FOI body, in this case DECC. Please therefore ensure that all such service providers, and their records, are identified and included to as part of your response to this request. 1.3 directly related to how DECC and any officials, servants or agents of DECC or the Minister concluded that Exola DAC and our Client did not meet the Investment Cover criterion as required by the Financial Capability Assessment Guidance.
