Under the Freedom of Information Act 2014, we hereby request all information held by LCC in connection with Dangerous Structure DB 2023 017. Information to include all Reports, photographs, correspondence, site notes, measurements, levels, gabion basket rupture and gabion wire diameter checks, emails, memos of conversations and phone calls, minutes of LCC MTM and other meetings. Information requested includes the following:- 1. All information held by LCC between the 48-page Report of the Dangerous Structure issued by us to LCC on 7/6/2022 and +E25 inspection by LCC 27/6/2023 including reason for the one-year delay in LCC inspection and fact finding. 2. All records made by Alan Wilson LCC on the 27/6/2023 during his visit to St Anthony's Trinity St., Drogheda in order to inspect the above adjoining dangerous structure situated on St Jude's including:- Alan Wilson's Site Notes, site measurements, Site Levels taken at top and bottom of retaining structures in both St Jude's and St Anthony's, Measurement and determination of retained heights and materials, inspection of fully collapsed section of gabion retaining wall to South end, photographs, Measurement of patent cracks widths and lengths in (a) Gabion retaining structure (b) Blockwork retaining sections on top, inspection of wire diameters in gabion baskets and lacing wires, inspection of ruptured and sagging of gabions, engineer's calculations, inspection of decayed timber deck sitting on said defective gabion and blockwork retaining structures, Report and Recommendations to Thomas McEvoy Director of Services LCC and all internal and external communications on the matter. 3. Record of the Dangerous Structure entered into the Register of Dangerous Structures as required under the 1964 Act. 4. Copy of DWDS Report instructed and obtained by LCC under Dangerous Structure Notice dated 14/7/2023. Report was subsequent to an inspection requested by DWDS and carried out by them from our property on 06/9/2023. 5. Copy of independent Reports obtained by LCC in connection with DB 2023 017. 6. Information on legal advice sought and legal action taken by LCC under Section 3(4) and Section 3(5) of the 1964 Act in connection with the failure of the gabion wall owner to comply with the Notice in terms her disavowed Engineer's Report and her Engineer's refusal to Supervise the works under Section (2) of the Notice, and her failure to complete works within 90 days under section (3) of the Notice. 7. Information on the basis for assurances given by T McEvoy to Sheila Fagan on 24/10/2023 that remedial work would commence shortly. Information on why this did not happen. 8. All communications between the Health and Safety Authority (HSA), LCC and the owner of DB2023 017 regarding Safety of Workers and Falling from Height.
