1.1 All records, created on or after 9 April 2021, relating to or referencing DECC's, the Minister of the Environment, Climate & Communications (the Minister) and any officials, servants or agents of DECC or the Minister, consideration of our Client's Lease Undertaking Application dated 9 April 2021 (the LU Application);. 1.2 All records, created on or after 9 April 2021, relating to or referencing the financial capability assessment which was carried out by DECC and any officials, servants or agents of DECC or the Minister, in the context of the LU Application. 1.3 All records, created, prepared and/or shared by any of DECC's external advisors, including but not limited to EY, in respect of this financial capability assessment. We would note that s.11(9) of FOI Act provides that a record in the possession of a service provider is deemed to be held by the relevant FOI body, in this case DECC. Please therefore ensure that all such service providers, and their records, are identified and included to as part of your response to this request. 1.4 All records, created on or after 9 April 2021, relating to or referencing how DECC and any officials, servants or agents of DECC or the Minister concluded that Exola DAC did not meet the Investment Cover criterion as required by the Financial Capability Assessment Guidance 1.5 All records, created on or after 9 April 2021, relating to or referencing how DECC and any officials, servants or agents of DECC or the Minister engaged with details of our Client's funding arrangement with Vevan Unlimited Company and our client's ability to fund the Work Programme associated with the LUApplication. 1.6 All records, created on or after 9 April 2021, relating to or referencing how DECC and any officials, servants or agents of DECC or the Minister concluded that Lansdowne Celtic Sea Limited failed to meet the required threshold for the Investment Cover ratio, Cash Cover Ratio and Current Ratio. Please provide us with the above records, created on or after 9 April 2021 and up to 19 May 2023 being the date of the decision on the LU Application, in searchable electronic format where available and otherwise in paper format. Without limiting the generality of our request, these records should include the following: A. Notes, memoranda, documents, files or correspondence; B. Messages held on all electronic devices used by DECC, the Minister and DECCs and/or the Minister's officials, servants or agents including text messages, Whatsapp messages, voicemails (or transcripts of same) or similar forms of electronic communication; C. Any records of meetings and/or telephone conversations between DECC, the Minister, and/or their officials, servants or agents, in respect of any record requested or issue outlined in this request; and D. All drafts of the said records
