I am researching Council procedures, regarding missing drawings in a planning permission obtained in !973, Please confirm the exact procedure of your Council to resolve a problem with a historical planning permission granted in 1973. Permission was granted for a private dwelling and is confirmed in writing. No objections were made by either the Council or the public and the dwelling was built. No modifications have been made since 1973. The drawings in the planning file are NOT the drawings submitted by the applicant in 1973. They do not contain the Applicants name, address, date or a scale of the drawings as required to issue a planning permission at the time.There is no Architect name on the drawings so it is not possible to contact that company. The drawings on file are generic but are not site specific. We, as present owners, are requesting that the Council confirm the house as built did have planning permission. Mediation is also offered by us to resolve as the correct drawings have obviously been mislaid by the council. What is the procedure of your council if this situation arose ? The query is not for a file in your Council. I merely wish to establish what is the procedure if such a problem arose in your Council area. If you are unable to confirm the procedure in your Council please forward this request to the relevant person in the Council and advise me of same. The problem arose in another Local Authority who are now claiming that the planning permission obtained in 1973 is invalid and I must apply for retention ( Quoted cost by Arch is 6,500) . I have queried the Planning Regulator and they have advised that this is not a SYSTEMIC problem / resolution and I should take legal action against the local authority. This I don't want to do and therefore I am trying to see how other authorities would deal with it. ​This is merely an information gathering exercise. Hope you can help as we are both in our seventies and don't have the 6,500 for a retention application ( drawings etc). I would appreciate any advice you can give me.
