Department of Justice, Home Affairs and Migration • All documents relating to the question of which body within the State is or has been legally entitled or required to consider the exercise of and/or to exercise the discretion of the State pursuant to Article 17(1) of Regulation (EU) No 604/2013. • All documents relating to the basis on which any body within the State is legally entitled or required to consider the exercise of and/or to exercise the discretion of the State pursuant to Article 17(1) of Regulation (EU) No 604/2013. • All documents in relation to or containing any guidelines, form or procedure for applying to the relevant body within the State which is legally entitled or required to consider the exercise of and/ or to exercise the discretion of the State pursuant to Article 17(1) of Regulation (EU) No 604/2013. • All documents relating to or indicating the following (we are especially interested in statistics in relation to the categories below): • The number of times State (Ireland) or any emanation of the State been asked to consider the exercise of and/ or to exercise the discretion of the State pursuant to Article 17(1) of Regulation (EU) No 604/2013; • The number of times the State (Ireland) or any emanation of the State has considered the exercise of and/ or exercised the discretion of the State pursuant to Article 17(1) of Regulation (EU) No 604/2013; • The length of time it has taken for the State (Ireland) or any emanation of the State to consider the exercise of and/ or to exercise the discretion of the State pursuant to Article 17(1) of Regulation (EU) No 604/2013 in cases falling under (i) and/or (ii) above. • All correspondence between the Minister and/or any other organ or emanation of the State and/or the European Commission in relation to Article 17 - this category should include all information and updates in relation to the way in which the Dublin III Regulation is being implemented. It should include but not be limited to communications pursuant to Article 35 of the Dublin Ill Regulation; documentation in relation to monitoring and evaluation for the purpose Article 46 of Dublin Ill and statistics under Article 47 of the Dublin Ill Regulation.
