1. A copy of the preliminary legal advice referred to on the Department of Health website, as identified above; or 2. In the event that the Department of Health seeks to rely on any of the reasons contained in Part 4 of the Act as the basis not to disclose the full preliminary legal advice, I request: a. Confirmation of whether this preliminary advice was provided orally or in writing; b. Details of the specific aspects of the EU’s Single Market rules and the Tobacco Products Directive which were relied upon in producing that preliminary advice; c. Details of the relevant factors relied upon which were applied to the legal framework; d. Clarification whether the advice was intended to apply only to Ireland, or was considered to be applicable to other Member States; and e. Confirmation whether any substantive legal advice was subsequently provided after the preliminary advice and, if so, what the outcome of that advice was.
