I am writing to request access to records held by the Department of Health under the Freedom of Information Act 2014. This request pertains to the rationale behind the €250,000 annual funding threshold used to distinguish between smaller and larger Section 39 organizations, and the decision to provide automatic redeployment rights to employees of larger organizations but not smaller ones, as outlined in Clause 2(b)(i) and (ii) of the Section 39 Service Arrangement (Revised for 2025). I seek the following records for the period from 1 January 2000 to the present date: 1. All policy papers, internal memos, reports, legal advice, correspondence, or meeting minutes explaining or justifying the establishment and use of the €250,000 annual funding threshold to differentiate between small and large Section 39 organisations. 2. Any equality impact assessments, risk analyses, or evaluations conducted by the Department of Health assessing the effects of the €250,000 threshold on employees of Section 39 organisations, including any consideration of potential disparities in treatment or outcomes between employees of small and large bodies and any consideration of potential disparities in treatment or outcomes between employees who have a disability and those who do not.. 3. Records detailing the decision to include automatic redeployment rights under Clause 2(b)(i) and (ii) of the Section 39 Service Arrangement for larger organisations (funded over €250,000), including the rationale for excluding such rights from smaller organisations (funded under €250,000).
