Department of Transport Context of Request: access is sought to further documents and correspondences in light of the decision made for FOI request FOI2017098; in the context of Request FOI2017098, reference is made to records 11 and 47. Record No. 11 is a letter from Liam Kavanagh to Fintan Towey of the Department. Mr. Kavanagh's letter is a response to a letter from Fintan Towey (21 September 2007) that apparently informed the Authority that it was "prohibited under Section 41(5) of the Irish Aviation Authority Act, 1993 from implementing the majority of the changes it proposes to its Superannuation Scheme in respect of Pre-vesting employees who transferred to the Authority under Section 40 of the Irish Aviation Authority Act, 1993". From Record No. 47 we learn that the prohibition mentioned in Record No. 11 was on the advice of the Attorney General. I have two observations here. The first is that Fintan Towey's of the 21st September 2007 was not supplied in response to the FOI request nor was it included in the Schedule of Records even under the heading "R = Refused". Secondly, given the contents of Liam Kavanagh's letter (Record No. 11) it is reasonable to assume that there was some form of communication between the Authority and the Department on the proposed (in the event) prohibited changes. The FOI response does not include this communication.
