In January 2021, the Court of Justice ruled that in effect the 2018 Reception Regulations, in introducing the 'applicant'/'recipient' distinction is contrary to the EU Reception Conditions Directive (Recast) 2013. This only impacts on access to the labour market. The Court of Justice case numbers are; C- 322/19 and C-385/19. FOI Request (Temporal Scope: January 2021 to April 2021): Any decisions/discussions/communiques (electronic or hard copy) etc. from officials within the Department of Justice with the Labour Market Access Unit detailing the response to C-322/19 and C-385/19 and permitting protection applicants, subject to Dublin III procedures, to enter the labour market, under a labour market access permission.
