...The record(s) sought are simply evidence to show that a mechanism exists to advise HSI that due to the OIC findings it cannot, since August 2022, take the position that it is not a public body and therefore not within the remit of the FOI act. And, by association, the same mechanism will have been used to communicate that message to decision makers on HSI requests. As mentioned in my initial request, the refusal reason given in FOI/24/105 indicates that OIC decisions are not considered by DAFM in relation to subsequent requests to DAFM about HSI. I am now, since 1st July, seeking records which show whether this is ir is not the case.
