Tipperary County Council This request relates to the Suir Blueway at Kilsheelan and the Council's position that the Blueway is recorded on the Council's Road Schedule as Road L-6516 and has been declared a public road pursuant to the Roads Act 1993. To enable the records to be identified by reasonable steps (FOI Act 2014, s12), this request is limited to the section of the Blueway/towpath adjoining my property at Kilsheelan. If required, I can provide an Eircode or marked-up map. Please provide copies of the following records held by Tipperary County Council (including attachments): 1) Declaration / legal instrument All records comprising the decision, order or instrument by which the Suir Blueway (or the relevant section at Kilsheelan) was declared a public road under the Roads Act 1993, including any schedules, maps or public notices. 2) Road Schedule and map – L-6516 The Road Schedule entry for Road L-6516 and the corresponding map(s) showing the precise route and extent at Kilsheelan (Roads Act 1993, s10(5)). 3) Mapped extent in usable format (GIS) Any GIS/polyline/shapefile or other electronic mapping records used to represent Road L-6516 and/or the Suir Blueway in the Council's systems. Pursuant to FOI Act 2014, s17 and s17(4), I request access in electronic form where held (for example: GIS export, PDF map extract, or screenshots of the relevant layer with legend and scale). 4) Records defining extent, width, alignment and responsibility (Kilsheelan section only) Any records that define or describe the legal extent, width or alignment of the route at Kilsheelan, including any taking-in-charge, vesting, wayleave or route-definition documents, insofar as such records are relied upon to define Road L-6516 / the Suir Blueway. 5) Agreements affecting control of the route (Kilsheelan section only) Any agreements or formal correspondence between Tipperary County Council and Waterways Ireland (or any other body) that define or affect the alignment, extent, control or responsibility for the route at Kilsheelan. Scope/time limit (to avoid unnecessary burden): This request is limited to records currently in force and relied upon, and any earlier foundational instruments still relied upon, plus records created or updated in the last 10 years insofar as they relate to the above.
