Request for access to a letter from the European Commission to the Government, dated 01/02/2023. According to a press release from the Department, dated 03/02/2023 (link: https://www.gov.ie/ga/preasraitis/80b13-european-commission- confirms-closing-of-derrybrien-infringement-case/), the Commission’s letter is related to infringement case 2000/4384 and judgments of the Court of Justice of the European Union in cases C-215/06 and C-261/18 regarding the implementation of the EIA Directive in Ireland. Also according to the press release, the Commission's letter stipulates that pursuant to An Bord Pleanála’s decision of 04/02/2022 to refuse substitute consent to the Derrybrien Wind Farm Project, Ireland has taken all measures necessary to ensure compliance with these judgments.
