I wish to request access to records held by Tipperary County Council concerning the sale ofWoodville House, Ballymackey, Co. Tipperary in 2019 and any associated lands which previously formed part of the Council’s Ballaghveny landfill facility, and which are now the subject of private development for an industrial-scale biogas plant. Specifically, I request: ​Decision-making process All records relating to the decision to sell Woodville House and associated lands. The names and roles of the officials and/or elected members involved in the decision making or approving the sale. Any minutes, reports, or internal memoranda relating to the disposal of the property. Communications with the purchaser All correspondence (letters, emails, meeting notes, phone call records, file notes) between Tipperary County Council and the purchaser (or their representatives/agents) concerning the sale, before, during or after the sale or the property. Records of any representations made by third parties (including developers, lobbyists, or intermediaries) regarding the purchase. Communication with the purchaser regarding contamination of the land. Contract of sale of the property. Landfill & Environmental Contamination Records of environmental assessments, soil and groundwater testing, or contamination studies carried out on the land prior to its sale. Details of any remediation works carried out by or on behalf of the Council before the sale. Copies of risk assessments concerning potential health or environmental hazards connected to the former landfill. Responsibilities & Liability The legal and financial responsibilities of Tipperary County Council regarding contamination of the site following the sale. Clarification on whether liability for remediation, monitoring, or environmental management was transferred to the private developer or remains with the Council. Records of communications with the Environmental Protection Agency (EPA) regarding the sale and environmental management of the land. Community & Environmental Impact Any consultation records with residents, businesses, or environmental groups regarding the sale and future use of the land. Any consideration given to the potential risks of further development on the site. Records relating to the Council’s assessment of the impact on local infrastructure, safety, and the environment. Consultation with external bodies Any communication between Tipperary County Council and the Department of the Environment, Climate and Communications regarding the disposal of this property. Any communication with the Environmental Protection Agency or other statutory bodies regarding the sale. Valuation and sale process All records showing how the Council determined the market value of Woodville House and associated lands. Details of what steps were taken to achieve the highest possible price for the property. Records of whether the property was placed on the open market, tendered, or sold privately. The name(s) of any estate agents or auctioneers engaged in the sale and the terms of their appointment. Copies of valuation reports, marketing materials, or sales brochures relating to the property. Records of oversight and accountability Any internal audit or review of the disposal of Woodville House and associated lands. Any legal advice obtained in relation to the sale. For the avoidance of doubt, this request coversall records, including but not limited to emails, letters, reports, file notes, meeting minutes, contracts, memos, text messages, and records held electronically or in hard copy.
