    I would like to request the following environmental information: • • An explanation of the necessity of the works, in view of the ecosystem services provided by the trees and vegetation removed, particularly in regard to the interception of sediment, fertilizer, pesticide, etc. associated with the agricultural use of the field adjacent; • • An explanation of the necessity of the works, in view of the provision of an invaluable ecological corridor adjacent to a sensitive freshwater ecosystem used by Qualifying Interests of both the River Boyne and River Blackwater Special Area of Conservation and Special Protection Area; • • Whether mitigation measures as described in the document “Office of Public Works Arterial Drainage Maintenance Works – Boyne Arterial Drainage Scheme Natura Impact Statement” as prepared by JBA consultants were implemented, and if not, why not (cf. mitigation measures against the physical disturbance of habitats (and loss of wood vegetation cover); • • Whether an Ecological Impact Assessment was undertaken as regards the potential impact of the works on the ecological integrity of the River Boyne and River Blackwater system (i.e. those species/habitats for which the sites are not designated, but which are integral to the ecological integrity of the Natura 2000 sites – cf [2018] C-461/17 Holohan v An Bord Pleanála) – in particular potential impacts on Daubenton’s Bat, which are known to occur along this stretch of the river Blackwater in significant numbers; • • Whether an ecologist was present on site immediately prior to the works for a site inspection and a copy of any report associated with such an inspection; • • Whether the NPWS were informed of the works being undertaken, and any correspondence with NPWS; • • A copy of the site-specific biosecurity measures put in place, considering the ecological sensitivity of the site and the occurrence of numerous species present on Part (1) of the Third Schedule of the European Communities (Birds and Natural Habitats) Regulations of 2011 within the catchment; • • The location of the machinery/equipment utilized prior to their use at the subject site and treatment and any implications for works undertaken; • • Given the nature of the equipment (long-reach excavator) why was this equipment utilized given that it is typically utilized for dredging activity? and • • The constraints, if any, facing the OPW in undertaking their statutory obligations as regards to the prevention of any significant negative impacts on the Conservation Objectives of the Qualifying Interests of the Natura 2000 sites in question.
