The attached Guidelines are in operation in the Revenue Commissioners regarding suspensions of staff including payment to staff during suspension. Section 14 the Guidelines refer to advice received from the Department of Finance regarding the definition of 'Ordinary Remuneration' that's payable to staff during suspension, as follows: “’Ordinary Remuneration’ is not formally defined, but it can be taken to mean an officer's stable rate of pay over a reasonable period, say, the previous three months. If that stable rate of pay included allowances, then these allowances would be considered to be part of ordinary remuneration. Overtime pay is not included for ordinary remuneration purposes (as overtime payments are only made when the officer actually does the overtime). If an officer has received an allowance such as an acting up allowance for a short period of time only, it may be excluded from 'ordinary remuneration', in that it does not yet constitute part of the officer's stable rate of pay (which is the pay he/she has been receiving for a reasonably extended period of time).” Under the Freedom of Information Act 2014 I am seeking access to this advice from the Department of Finance to the Revenue Commissioners and to any records that may have amended this advice at any later point. In addition, I am seeking access to any advice that may have been issued from the Department of Finance or the Department of Public Expenditure and Reform to any other Government Department regarding the matter of the definition of 'ordinary remuneration' for the purposes of paying 'ordinary remuneration' to employees during periods of suspension.

To provide the terms and conditions relating to the role of Labour Inspector (WRC) in the Department of Enterprise, Trade and Employment, specifically relating to the required working hours of officers in EO grade in role of Labour Inspector. And to confirm from those terms and conditions, if the allowance associated with the role requires officers in the role to work any additional hours in excess of the daily and weekly working hours appropriate to the EO grade, ie, no less than 35 hours per week? To confirm from those terms and conditions, if any additional hours worked by Inspectors in excess of the daily and weekly working hours appropriate to the EO by Inspectors incur overtime rates of pay. The reason I would like to request this information is to understand how a successful business case / submission was made to DPER authorising the appoint an appropriately qualified and remunerated clinical specialist to the Defence Forces to improve the quality of patient care. For info: On Thursday 17 Jan 2019, the then Minister Paul Kehoe stated in the Dáil record "The proposal I approved before Christmas [2018] has gone to the Department of Public Expenditure and Reform for final sign-off. As the Deputy stated, the salary offered is only half of what may be on offer in the private sector or the HSE. That is probably the main reason for the lack of applications for the position that was advertised."

For recruitment campaign 1529103, why was Assistant Principal pay scale used and not Professional Accountant Grade 1 ? 2. Why was the Assistant Principal pay scale NOT deemed appropriate here in recruitment campaign 17123209 ? 3. Were there any changes made around that time 2015-2016 eg: streamlining of around technical grades that might explain a. the prevalence of the Professional Accountant Grade 1 pay scale b. this use of different pay scales in recruitment campaign 1529103 and 17123209. 4. Given their similarity, why was the same pay scale not applied to both competitions ? 5.
